Frequently Asked Questions

  • How long does all this take and is it complicated?
At Midland Wills our first priority is putting your mind at ease. We begin by booking in a discovery meeting with you for 1 hour in your own home at a time that suits yourself. This is free of charge with no obligation, we are consultants not salespeople and you will never feel pressured into anything. In that meeting we will discuss you, your family, look at what counts as your "estate", your wishes, answer any questions you have and together discuss the best solutions to ensure your needs and wishes are met. If you decide to go ahead with some planning we take simple instructions from you and once we have all the information, we will start drafting the documents for you to check over before creating the final documents for you to sign. A simple Will/Mirror Wills can take 2-4 weeks to produce. Power of Attorney can take 2-4 weeks to produce but up to 16 weeks to be registered with the Office of Public Guardian. Trust can take 8-12 weeks to draft and complete.
  • What do I need to think about when arranging my Will?
When considering your Will the things to consider are: Do I want to do this right now? - Discussing the inevitability of life can be difficult, consider if this is the right time for you. But this is one thing that shouldn't be put off forever. What forms my estate and what is it worth? Who will be my Executors? This is the person(s) who will manage all of your affairs after you have passed away and deliver the inheritance to your Beneficiaries. Who do I want to inherit and when? Who do I not want to inherit, if applicable? Do you have children under 18 years of age? Who will look after them if you're incapacitated or no longer around so Guardianships should be considered. What are my concerns? What happens if I need to go into care? There are potentially lots of things to consider but producing your Will can be very simple and our consultants will help you through every aspect of this.
  • Do I need a Will or to update my Will?
If your wish is to be the one to decide who is to inherit then the answer is "yes", you more than likely do need a Will. If you don't have a Will then you are determined to have died "intestate" and the courts will follow the Laws of Intestacy and decide who will ultimately benefit from your estate, which may not be the people you want. It's also recommended a Will should be reviewed every 3-5 years. Life changes quickly and it maybe that someone named in your current Will has passed away, has become estranged from the family or maybe you wish to add beneficiaries. As your life changes your Will can too.
